Medical cannabis in Spain: documents, travel and legal questions

Start with the prescribed product

Spain’s National Formulary includes a standardized cannabis oral-solution preparation. That entry is not an individual prescription or confirmation that a particular patient can obtain treatment.

Ask your treating professional which product and care pathway apply to you. Record the medicine’s full name, formulation and prescriber. A product described online as CBD or cannabis is not enough information to assess your situation.

Use the current AEMPS travel procedure

AEMPS’ August 2026 FAQ specifies a 15-day maximum for incoming cannabis or derivative medication and requests applications at least ten days ahead. Check the precise procedure for your trip.

Avoid copying an old forum checklist. Open the official FAQ, compare its date with your departure, and ask AEMPS about the exact product, quantity and route if anything is unclear. Do this while there is still time to obtain missing documents.

Build a document pack you can use

AEMPS distinguishes ordinary personal medication from controlled medicines requiring a travel permit or certificate. It also notes that a prescription or medical report may be requested at entry or exit.

Make a private folder for the authoritative instructions and the documents requested for your route. Keep a separate note of who answered your question and when. If the trip changes, check whether that answer still covers the new dates and border crossings.

Make the legal consultation specific

Prepare a short timeline: where you live, where the issue occurred, what document you received and any response deadline. Ask counsel to assess those facts, rather than asking whether cannabis is simply “legal in Spain.”

Useful questions include which authority to contact, whether your documents address the issue, and what the next step will cost. Share sensitive records privately when requested. For a CannaCards callback, select Spain as the matter’s country even if your residence is elsewhere.
